1. AGREEMENT TO LEGAL TERMS
These Terms of Service ("Legal Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Silver Flight Group, LLC ("Company," "we," "us," or "our"), concerning your access to and use of the CalorieCoach mobile application and services (the "Services").
The Services include:
- Mobile application for food analysis and nutrition tracking
- AI-powered food recognition and analysis
- Subscription-based premium features
- AI health coaching and personalized meal planning
- Chat history and document artifacts
- Data storage and synchronization services
You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. OUR SERVICES
We provide a mobile application that offers:
Free Services:
- Limited daily food photo analyses
- Basic calorie estimates
- 7-day food history
- Basic nutrition logging
Premium Subscription Services:
- Unlimited food photo analyses
- Complete macro/micronutrient breakdown
- AI Personal Coach with unlimited chat
- Custom meal plan generation
- Exercise plan creation
- Unlimited history with export capabilities
- Advanced analytics and insights
- Document artifacts creation and storage
- Priority customer support
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice.
3. SUBSCRIPTION SERVICES
3.1 Subscription Plans
We offer the following subscription plans:
- Monthly Pro Subscription: Billed monthly
- Annual Pro Subscription: Billed annually
All subscription fees are non-refundable except as required by applicable law or as specifically stated in these terms.
3.2 Billing and Payment
- Subscriptions are billed in advance on a recurring basis
- Payment will be charged to your App Store account (iOS) or Google Play account (Android)
- Subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage your subscription and turn off auto-renewal in your device's account settings after purchase
3.3 Free Trials and Promotional Offers
We may offer free trials or promotional pricing for our subscription services. You will be charged the subscription fee at the end of the trial period unless you cancel before the trial expires. Special pricing offers may have different terms, which will be disclosed at the time of the offer.
3.4 Price Changes
Subscription prices may change from time to time. If we increase subscription prices, we will provide advance notice and you will have the opportunity to cancel your subscription before the price increase takes effect.
4. CANCELLATION AND REFUNDS
4.1 Cancellation
You may cancel your subscription at any time by:
- Going to your device's Settings → Subscriptions (iOS)
- Opening Google Play Store → Menu → Subscriptions (Android)
- Contacting our support team
Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of your paid subscription period.
4.2 Refunds
- Refunds are generally handled by Apple App Store or Google Play Store according to their respective refund policies
- You may be entitled to a refund under certain circumstances as required by applicable law
- For questions about refunds, contact Apple or Google customer support first
- If you believe you are entitled to a refund that has been denied, you may contact our support team
4.3 Refund Exceptions
We may provide refunds at our sole discretion in cases of:
- Technical issues that prevent you from using the service
- Billing errors or unauthorized charges
- Service outages lasting more than 48 consecutive hours
5. CHAT HISTORY AND ARTIFACTS
5.1 Chat Services
Our premium subscription includes access to an AI health coach through a chat interface. Your chat history includes:
- All messages exchanged with our AI coach
- Timestamps and metadata
- Attachments and images shared in chat
- AI-generated responses and recommendations
5.2 Document Artifacts
Our AI coach may create documents for you, including:
- Personalized meal plans
- Exercise routines
- Shopping lists
- Educational materials
- Progress tracking documents
5.3 Data Retention for Chat and Artifacts
- Chat history and artifacts are stored for the duration of your active subscription
- Data is retained for 30 days after subscription cancellation to allow for service restoration
- After 30 days, chat history and artifacts are permanently deleted unless required by law to retain longer
- You may request immediate deletion of your chat history and artifacts by contacting support
- We maintain encrypted backups for disaster recovery purposes
6. USER DATA AND PRIVACY
6.1 Data Collection
We collect and process the following types of data:
- Account information (name, email, profile data)
- Food photos and analysis results
- Nutrition tracking data
- Chat conversations with AI coach
- Usage analytics and app performance data
- Device information and identifiers
6.2 Data Retention
- Account Data: Retained while your account is active and for 3 years after account deletion
- Food Photos: Retained for 7 years for AI model improvement (anonymized after 1 year)
- Nutrition Data: Retained while account is active and for 3 years after deletion
- Chat History: Retained during active subscription plus 30 days after cancellation
- Artifacts: Retained during active subscription plus 30 days after cancellation
- Usage Analytics: Retained for 2 years in anonymized form
6.3 Data Deletion
You may request deletion of your personal data at any time by:
- Using the in-app data deletion feature
- Contacting our support team
- Following the process outlined in our Privacy Policy
We will delete your data within 30 days of your request, except where retention is required by law.
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Our Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of Silver Flight Group, LLC and its licensors. The Services are protected by copyright, trademark, and other laws.
7.2 Your Content
By uploading food photos, creating notes, or using our chat services, you grant us:
- A license to process and analyze your content to provide our services
- The right to use anonymized data for improving our AI models
- Permission to store your content as necessary to provide the services
You retain all other rights to your content.
7.3 AI-Generated Content
Content generated by our AI coach (meal plans, exercise routines, recommendations) is provided for informational purposes only. While you may use this content for personal purposes, we retain rights to the underlying AI technology and methods.
8. PROHIBITED USES
You may not use our Services:
- For any unlawful purpose or to solicit others to unlawful acts
- To violate any international, federal, state, or local regulation or law
- To transmit or procure the sending of advertising or promotional material
- To impersonate or attempt to impersonate the Company, another user, or any other person or entity
- To upload content that is harmful, offensive, or violates others' rights
- To interfere with or circumvent the security features of the Services
- To reverse engineer or attempt to extract source code from our application
9. DISCLAIMERS
9.1 Health and Nutrition Disclaimers
THE SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.
9.2 AI Accuracy Disclaimers
OUR AI FOOD ANALYSIS AND HEALTH COACHING FEATURES ARE PROVIDED "AS IS" AND WE MAKE NO GUARANTEES ABOUT THE ACCURACY OF CALORIE ESTIMATES, NUTRITIONAL INFORMATION, OR HEALTH RECOMMENDATIONS.
9.3 Service Availability
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE AVAILABLE AT ALL TIMES. WE MAY EXPERIENCE HARDWARE, SOFTWARE, OR OTHER PROBLEMS OR NEED TO PERFORM MAINTENANCE RELATED TO THE SERVICES, RESULTING IN INTERRUPTIONS, DELAYS, OR ERRORS.
